The KFC brand owners are stalling the purchase of the Kentucky restaurant and estate created for Harland Sanders for his wife in 1959 because of trademark concerns.

Claudia’s Dinner House – located in Shelbyville – is owned by the Sanders family and their friends Tommy and Cherry Settle, and now Settles is committed to finding a new ‘custodian of this historic brand’.

Settles are said to be seeking $9 million for real estate, which includes the dinner home, the mansion known as Blackwood Hall, three acres of land and intellectual property, including a KFC flag and a painting Happy birthday letter to Sanders from President Richard Nixon.

Despite a few offers, from franchising for the first time to turning it into an Airbnb, KFC brand owner Yum! Brands’ legal team blocked the transaction by filing an application with the US Patent & Trademark Office just days after the property hit the market in June.

The filing seeks to strengthen KFC’s trademark protections, including ‘Colonel Sanders’ Original Recipe’, ‘Col. Harland Sanders’ and ‘It’s Finger Lickin’ Good,’ according to the New York Post.

‘It’s a very unique situation,’ Six Degrees Real Estate broker Jonathan Klunk told the Post. “We’re selling Claudia and she’s not as well known as her husband, but buyers can’t describe her without mentioning both her husband and KFC.”

Klunk said there are ‘a lot of similarities’ between the KFC menu and Claudia’s Diner, but the dinner restaurant’s dishes ‘have nothing to do with the KFC recipe.’

However, The Settles clashed with Yum! Brands in 2001, according to the Post, when Tommy found a notebook dated from 1964 containing a list of 11 herbs and spices in Blackwood Hall. He wants to authenticate it to sell it, but Yum! sued.

The case was later dropped after the brand’s owner said the formula bore nothing close to the famous combination sold in stores today.

Despite disagreements between the brand and future owners, Klunk said the $6.5 billion conglomerate has not yet offered to buy the property.

Brokers also said they are considering splitting properties to sell each property separately to attract more buyers.

Potential buyers have, to date, ranged from a local bourbon company interested in expanding into comfort food, as well as large and local restaurant groups and serial entrepreneurs with many trademark.

All potential buyers must speak to Yum! to detail how they intend to use the trademark without inviting litigation.

“If you want to use the Claudia Sanders brand, you have to have a team of intellectual property lawyers,” Klunk warned buyers, according to the Post.

Trademark Attorney Brad D. Rose told the Post: ‘Whoever is going to take on the Claudia Sanders name is probably going to have to go through an uphill and expensive fight.

The diner was originally supposed to be the headquarters of KFC after Sanders closed their Corbin KFC location in 1952. That same year, Sanders would begin franchising his company, which would eventually become a global icon.

The couple opened Claudia Sanders Dinner House in 1959 when they moved to Shelbyville. Kentucky.com says it will become known for its yeast rolls, large buffets, pies and fried chicken.
