'Two finger test to confirm patriarchal, sexist rape': Supreme Court

The Supreme Court has ordered the center and the states to ensure the practice is stopped.

The Supreme Court today sternly upheld the use of the “two-finger test” in rape and sexual assault cases and ordered the center to ensure the cessation of the practice.

The Supreme Court said when it ruled that any individual conducting a “two-finger test” on a survivor would subject them to a relapse of psychological trauma.

“It is patriarchal and sexist to suggest that a woman cannot be trusted when she says she was raped just because she was sexually active,” the highest court said.

A Supreme Court bench consisting of Judge DY Chandrachud and Judge Hima Kohli made these remarks while recovering convictions in a rape case.

The bench overturned the Jharkhand High Court’s decision acquittal of a rapist and murder, while upholding a trial court’s decision to find him guilty.

The highest court directed the center and the states to review the curricula in all private and government medical colleges, and to remove the research literature on the “double-diploma test.” finger”.

The Supreme Court also ordered the health department to hold workshops for health care providers in all states and announce the proper process for screening sexual assault survivors.

In 2013, too, the Supreme Court ruled that the “two-finger test” violated a woman’s dignity and privacy.
