‘Sane view’, says Union law minister Kiren Rijiju of high court ex-judge’s collegium criticism | India News



NEW DELHI: Amid the ongoing controversy between the Center and the judiciary over the appointment of judges through the university system, the Union law minister Kiren Rijiju on Sunday quoted in his Twitter handle an interview by Justice RS sodhi (retd), a former judge of Delhi High Court. Sodhi has commented that the Supreme Court “breached the Constitution for the first time” to the extent that the judges decided to appoint judges, negating the role of the government.
Commenting on the interview, Rijiju tweeted: “The voice of the judge. . . The real beauty of Indian democracy is its success. The people govern themselves through their representatives. The elected representatives represent the interests of the people and make laws. Our judiciary is independent and our Constitution is supreme. “
In his YouTube interview, Sodhi has said that lawmakers have the power to frame the law. “If there is an impasse between the government and the Supreme Court, who makes the final decision? That’s the President. He appoints judges, and how does he do it? With the advice of the council of ministers,” he said, noting that Parliament is supreme in a democracy because its members are elected by the people of the country.
“Can you amend the Constitution? Only the National Assembly can amend the Constitution. But, here, I feel the Supreme Court violated the Constitution for the first time. After the hijacking, they (SC) said: ‘We will appoint ourselves (the judge) and the government will have no role in it,'” Sodhi commented.
Rijiju agreed with the former judge’s view, saying: “Actually, most people have the same sane opinion. Only those who disregard the provisions of the Constitution and the duties of the people think that they are above the Constitution of India. “
Sodhi also said the high courts are not “dependent” on the Supreme Court, but HC judges are starting to look towards SC and become dependent.
