Rahul’s position on Article 370 has consistently been in line with the party’s position since Jammu and Kashmir lost its special status.

However, he evaded direct replies on both occasions. His popular refrain was that the party’s stance was mentioned in a resolution passed at a meeting of the Congressional Work Committee (CWC) of the top decision-making body.
In fact, Congress has so far avoided making a clear position on Article 370 and Rahul does not want to create controversy by stating anything new. Therefore, he repeatedly reiterated that the CWC resolution is the final decision of Congress on Article 370.
One of the main reasons behind Congress’s conservative stance on the controversial provision of the Constitution could be the general perception that is said to support the Modi government’s move to deny it.
Congress and repeal Article 370
The government’s move to Articles 370 and 35A stunned everyone including Congress. It took 24 hours for Rahul to criticize the Center for stripping Jammu and Kashmir of special status.
On August 6, 2019, he tweeted and said: “National integration is not promoted by unilaterally dividing J&K, imprisoning elected representatives and violating our Constitution. “This is made by the people, not the pieces of land. This abuse of executive power has serious implications for our national security.”
On the same day, the CWC passed a resolution opposing the “how” the Modi government invalidated Article 370.
The resolution said, “The CWC opposes the unilateral, blatant and completely undemocratic way in which Article 370 of the Constitution was repealed and the State of Jammu and Kashmir was divided due to misunderstanding of the provisions of the Constitution. . Every principle of Constitutional law, the rights of the States, Parliamentary procedure and democratic governance is violated.”
It added that Article 370 was conceived and crafted by Pandit Jawaharlal Nehru, Sardar Vallabhai Patel and BR Ambedkar, supported by N Gopalaswamy Iyengar and VP Menon. “Article 370 is the constitutional recognition of the provisions of the Instrument of Accession between the State of Jammu & Kashmir and India. It deserves to be honored until it is amended, after consultation with all sections of the people, and in strict observance of the Constitution of India.”
Two years later, Rahul made a two-day visit to Jammu and Kashmir in August 2021. He asked UT to restore full state status. However, like other senior leaders in his party, he avoided mentioning the controversial Article 370.
While inaugurating the new party office in Srinagar, Rahul said the Parliament demanded the restoration of full state status to Jammu and Kashmir and the restoration of the democratic electoral process there.
And now he has maintained the same position in his Bharat Jodo Yatra.
Parliament Rajya Sabha MP Digvijaya Singh was once controversial. In a chat at the Clubhouse, leaked in June 2022, he is said to have said: “The decision to repeal Article 370 and reduce the state status of Jammu and Kashmir is an extremely sad decision. And the Congress party will definitely have to rethink this.”
This created a huge uproar. Congress was forced to clarify its position on the controversial issue. Contrary to Singh’s statement, the party asked its leaders to follow their official stance on nullifying Article 370.
Parliamentary spokesman Pawan Khera said: “The Congress Party has clearly stated its position on Jammu and Kashmir, in the August 6, 2019 resolution of the Parliamentary Work Committee (CWC). the only official party school. I appeal and ask all senior leaders to make such references.”
So far, the CWC resolution remains the party’s official position on Article 370. Rahul has repeated the same thing over the past few days.
As for his claim to restore state status to Jammu and Kashmir, that is nothing new. In fact, Prime Ministers Narendra Modi and Amit Shah have also repeatedly assured to restore statehood to Jammu and Kashmir at “the appropriate time”.
