Officers from the California Highway Patrol arrived at the scene at 10 p.m. on May 28 and found Pelosi sitting in the front seat of his car emitting a strong odor.

In newly obtained court documents obtained by the New York Post, officers said he also failed a field sanity test and that his eyes appeared ‘red and watery.’

The 82-year-old had been attending a dinner with friends before the crash and was driving back to his palatial vineyard home in St. Helena nearby.

At the time of the incident, he was trying to cross State Road 29 – a busy highway connecting Napa and Calistoga – when he crashed into a 2014 Jeep driven by 48-year-old Jesus Lopez.

Lopez suffered minor injuries and declined to speak about the incident, later citing California’s Marsy Law that protects victims’ privacy and also allows them to seek compensation from the person who harmed them if found guilty.

He was referred to in the complaint as ‘John Doe’, also noting that he experienced headaches he had never done before due to the accident.

CHP sources told DailyMail.com that both cars were wiped out in the smash.

The dramatic new development comes after DailyMail.com revealed Pelosi had a history of driving and was involved in a smash that killed her brother David when he was just 16 years old.

According to a 1957 report in the San Francisco Examiner, Pelosi, then a sophomore in high school, picked up 19-year-old David from a girlfriend’s house at 12:30 a.m. and the brothers made up their mind. go ‘a fun trip’.
