NYC judge faces possible removal
The request came on July 22 following allegations that Judge Erin Gall threatened black teenagers at a 2022 graduation party.
EVERYBODY Erin P. Gall, a judge from Oneida County, gave a lengthy speech after the incident, the New York State Commission on Judicial Conduct released police body camera footage of the incident.
Body camera footage shows the teens searching for their lost car keys as Gall yells at them to leave and take an Uber home, according to media reports.
The video then shows a New York judge threatening to shoot the teens who are still looking for their car keys.
“If they come back looking for it, I will call you when they are on the property. If they do, they will be arrested or they will be shot on the property. Because when they trespass, you can shoot them on the property. I will shoot them on the property,” Gall said.
Newsweek Gall’s offensive outburst came after a clash between invited and uninvited guests at a party in New Hartford, New York, that she attended with her family, while four black teenagers arrived after watching the event on a livestream.
Gall eventually asked the police to arrest the four teenagers, repeatedly emphasizing that she was a judge.
When warned of the possibility of a lawsuit, Erin Gall assured officers she would support it.
“Listen, but guess what, the good part is — the good part is I’m always with you. You know I’ll kill anyone for you. You know that. You know I’m with you,” Gall cried.
What is the future of NYC judges?
AP reports that Erin Gall has been suspended with pay while the New York Court of Appeals deliberates.
However, Commission Administrator Robert H. Tembeckjian condemned Gall’s actions in a statement accompanying the report.
“It is completely unacceptable for a judge to threaten gun violence, express racial bias, promise favorable treatment for police officers, or water down laws aimed at keeping guns away from dangerous people,” Tembeckjian said. “Any of these things undermine public confidence in the administration of justice.”
Based on CBSErin Gall’s attorney plans to appeal, but the New York State Court of Appeals will have the final say on her deportation. Gall has said her actions and words toward the black teens were traumatized by the 1990 attack, according to the AP.
Gall’s attorney, Robert Julian, recommended a lighter sentence instead of removal from office.
“Judge Gall was remorseful, apologetic and accepted responsibility. She acknowledged from the outset that she was ashamed of her behaviour and humiliated by the way she reacted to the unexpected events that had occurred. In the opinion of psychologists, her behaviour was secondary to a trauma response, which we offer not as an excuse but as an explanation,” Julian explained.
