According to CNNon Thursday, October 3, Los Angeles County District Attorney George Gascón revealed that prosecutors are reviewing new evidence in the case of Menendez’s brother. The newspaper reported that prosecutors received a letter previously written by Erik “corroborating allegations that he was sexually abused by his father.”
“I tried to avoid dad. It’s still happening to Andy, but now it’s worse for me. I can’t explain it… I never know when it’s going to happen, and it drives me crazy. Every night I stay up all night thinking he might walk in. I need to get it out of my mind,” the letter, allegedly sent to Erik’s cousin, said Fox 35 Orlando.
Attorneys for Erik and Lyle Menendez reportedly asked the court to overturn the brothers’ 1996 conviction for the 1989 murder of their parents, Jose and Mary “Kitty” Menendez. Despite this, this newspaper reported that Gascón still affirmed that the two brothers committed murder. Therefore, his office will only consider new evidence and “make a determination as to whether it warrants a resentencing.”
“We have not decided the outcome yet. We are reviewing the information,” Gascón explained.
Cliff Gardner, the Menendez brothers’ attorney, reportedly responded to the LA District Attorney’s decision with a statement.
“Given today’s very different understanding of how sexual and physical abuse affects children — both boys and girls — and remarkable new evidence, we think that a resentencing was the appropriate outcome.” “The two brothers have been in prison for more than 30 years. That’s enough.”

According to this source, Erik and Lyle Menendez were 18 and 21 years old, respectively, when they committed the murder of their parents. Both brothers said they were sexually, physically and mentally abused by their parents for many years,” Kardashian’s letter reads in part. “…The media turned the brothers into monsters and sensationalized them – two rich, arrogant kids from Beverly Hills who killed their parents out of greed. There is no room for empathy, let alone sympathy. Erik and Lyle have no chance of a fair trial in this context.”
Kardashian went on to claim that the brothers were not supported amid accusations of sexual abuse because of their gender.
“Many people believe that the crimes the brothers committed are unforgivable – but what about the decades of alleged abuse they endured as children?” she added.
Before concluding, Kardashian explained that she “spent time” with Erik and Lyle Menendez behind bars and believes “they are not monsters.”
“The murders are unforgivable. I want to make that clear. Nor was their conduct before, during or after the crime. But we should not deny them today in their 50s,” she wrote. “…I do not believe that spending their entire natural lives in prison is an appropriate punishment for this complex case. If this crime were committed and tried today, I believe the outcome would be completely different… With their case back in the spotlight – and consider the revelation of a letter from 1988 from Erik to his cousin describing the abuse – I hope that the life sentences of Erik and Lyle Menendez will be reconsidered.”
