How a Faked-Evidence Case Against an Ex-N.Y.P.D. Detective Crumbled

Office spokeswoman Emily Tuttle said: “DA Bragg has prosecuted public corruption and police misconduct throughout her career and considers this work a top priority for the investigative team. how to be a district attorney. “When issues spotted from 2019 in this test were discovered, DA Bragg was immediately notified and deeply engaged in fixing these bugs where possible, and determining next steps.”

She said Mr. Bragg usually meets with the unit every two weeks and has seen them about two dozen times since taking office.

The appointment of Mr Viorst as head of the unit was announced in January 2021, with Ms Minogue joining the following month. In April, she became its deputy, a position she held until Tuesday, when the office dismissed her. She is still working.

Viorst also worked for Bragg when they were both in the New York attorney general’s office, leading a unit tasked with investigating police killings of unarmed civilians. It’s been tough work — the law makes it difficult to convict famous police officers, let alone plead guilty — but under their supervision, the unit has not come to a conclusion. any of the 24 cases they investigated. (Things haven’t gotten any better since then; the unit, now known as the Office of Special Investigations, has yet to be convicted.)

It is unclear whether Mr Bragg and Mr Viorst will be able to salvage the case against Mr Franco following the breaches of evidence. If they don’t, there are indications that there will be a strong case against the former detective.

One juror, Daniel Keehn, 30, said prosecutors had made convincing arguments against Mr. Franco.

“Prosecutors did a thorough job in arranging the case,” he said. “They did a great job building the foundation, looking at the evidence.”

Ms. Minogue questioned some of Franco’s former colleagues and supervisors, and many were reluctant to condemn the former detective’s work. No one said they believed he misinformed them, even after they reviewed the prosecution’s video evidence.
