Halle Berry wants sole custody of son amid difficulties in co-parenting

Halle welcomed her 10-year-old daughter in October 2013, about three months after marrying Martinez. She is also the mother of a 15-year-old daughter named Nahla from a previous relationship with her boyfriend, Gabriel Aubry.

PEOPLE reports that Halle Berry filed the paperwork in court on Friday, August 16. At that point, it had been weeks since Martinez, 58, is said to have failed to continue seeing a parenting coach.

If sole custody isn’t a viable option, Halle wants the court to consider giving her “decisive decision-making power” over Maceo’s educational, health and therapeutic needs.

She claims that Martinez was “unwaveringly… resistant” to her concerns about their son’s “educational challenges” and behavioral concerns. Additionally, Halle Berry alleges that her ex-husband was “uncooperative for years” with her efforts to support their son with resources such as appropriate learning environments and educational assessments.

Berry’s petition reads: “As a result of Respondent’s resistance to any intervention over the years and as a result of Respondent prioritizing soccer activities over Maceo’s educational and mental health, Maceo’s educational and behavioral challenges have worsened and he continues to fall further behind in school.”

Furthermore, the mother of two hinted that her ex-husband had repeatedly had private “disputes” with Maceo. She also claimed that their son’s behavior towards her had changed after “a long period of raising children” with his father.

Meanwhile, Martinez’s attorney told PEOPLE they plan to respond in court in the coming weeks.

Halle & Olivier’s divorce and custody agreement took eight years to finalize

To put things into perspective, the former couple filed for an annulment in 2015 and became legally single in December 2016. However, their divorce was not finalized until August of last year. At that time, a judge ruled that Berry had to pay Olivier Martinez $8,000 in child support per month while still sharing legal custody.

She was also ordered to pay her ex-husband 4.3% of any income she earned over $2,000,000. by PEOPLEIn addition, Halle’s mother is also financially responsible for Maceo’s private school tuition, uniforms, school supplies, and extracurricular activities. Berry also agreed to pay her son’s father back wages for these responsibilities during the 2023-2024 school year.

Earlier this month, a judge denied Halle Berry’s request to intervene in their shared custody agreement after her ex-husband missed instruction sessions. This reported custody petition is the latest update on her custody troubles with Martinez.
