Fraud in MBBS admissions: Bombay HC stays acquittal | Mumbai News



MUMBAI: Bombay High Court has granted a temporary adjournment on the acquittal of a judge in a fraud case against Satara-based Shri Chhatrapati Shivaji former president of the Education Association Shri Chhatrapati Shivaji, Mahadev Deshmukh and five people another accused of defrauding about 350 students Rs 29 crore by promising MBBS admissions.

Vaduj Police in Satara registered a fraud case against former president of Shri Chhatrapati Education Association Shivaji Mahadev Deshmukh and others in MBBS and FIR based admissions fraud, General Department of Enforcement (ED) filed a money laundering case. ED arrested Deshmukh in 2022; he is still in prison.
Last November, when acquitted of the defendant in the fraud case, the judge said: “The matter has been waiting for the defendant to appear since 2017. However, today, the informant appeared. in front of me and stated that he… wanted to withdraw the case against the accused This indicates that the informant had no complaints…so there would be no for any purpose in keeping the matter pending on file.”
Based on the judge’s order, Deshmukh and others applied for bail and release from money laundering before the special PMLA court, which dismissed the case last November. The ED and police discussed the development then, through the government, filed a written petition with the high court against the judge’s order.
Deshmukh was not served notice and his lawyer appeared in HC suo motu. Deshmukh’s attorney argued that any judgment rendered by Lok Adalat would be final and binding on all disputing parties and that there would be no appeal to any court against the ruling. But the court dismissed it, saying it was not an appeal but a petition. “There are 95 victims. Only informants [one of the victims] appeared before Lok Adalat and submitted a compromise statement,” said HC. HC said.
HC then upheld the acquittal until January 25, when the matter will be heard next.
