A subpoena has been issued to billionaire Larry Ellison, the co-founder of Oracle, Intel’s former CEO Robert Swan and Twitter Co-Founder Jack Dorseywho is currently the chief executive officer of Block Inc.

A five-day trial is scheduled to begin October 17 in Wilmington, Delaware.

Each side has accused the other of violating an April takeover agreement. Twitter wants a judge to order Musk, the chief executive of Tesla Inc and the world’s richest man, to acquire the company under an agreement with price 54.20 USD (about 4,300 Rs) per share.

Shares of the San Francisco-based company were down slightly early Tuesday trading at $41.54 (about Rs 3,300).

On Tuesday, Bloomberg report that court filings have revealed that Twitter co-founder Jack Dorsey will be ousted in the company’s lawsuit scheduled to begin next month. He was previously subpoenaed by the Tesla CEO in August and will be sworn in by Twitter and Musk on Tuesday, according to reports.

Musk has reported accused the company of concealing serious flaws in its data security. He also alleges that Twitter hid from him that it was not complying with a 2011 agreement with the Federal Trade Commission (FTC) on user data, based on statements by the whistleblower and former chief security officer.
