Elon Musk is trying to stop testing his Twitter for a month

Elon Musk’s Lawyers Today submit a petition to delay his trial against Twitter by a month, arguing that it needs more time to process the recent statements of whistleblower Peiter Zatko, Twitter’s former chief of security. With this offer, Musk’s legal team is trying to amend the claims against Twitter, using details from Zatko’s legal complaints against the company. The trial between Musk and Twitter is currently scheduled to begin in October, and the petition filed today will be pushed back to November.

This is the same tactic Musk is using to try to end his $44 billion acquisition of Twitter altogether. Twitter originally sued Musk in July in an attempt to force him to comply with their multi-billion dollar buyout agreement, and Musk protested, trying to get out of the deal. Musk’s legal team this morning filed a notice with the Securities and Exchange Commission’s request to cancel the acquisition, citing Zatko’s recent allegations of security deficiencies at Twitter. Zatko’s statement builds on Musk’s initial argument for ending his takeover of Twitter, accusing the company of significantly underestimating the number of bot accounts on the network.

Zatko filed a complaint last week with the SEC, the Department of Justice and the Federal Trade Commission accusing Twitter of gross negligence when it comes to information security. Zatko accused the company of encouraging the proliferation of spam accounts in the name of increasing user numbers, lowering the number of bot profiles on the platform, and running an entire business on outdated software. All are ready movement in Congress to investigate these claims.

Twitter said in court filings that Zatko’s accusations were contradictory and lacked context. The company has long argued that spam accounts make up less than 5% of Twitter’s total users. Musk, and now Zatko, thinks the real number is much higher.
