Diddy’s Lawyer Responds to $100 Million Lawsuit
TSR previously reported that Derrick Lee Cardello-Smith recently won $100 million after Michigan Judge Anna Anzalone ruled in his favor.
To put things into perspective, Cardello-Smith filed a civil lawsuit against Combs, citing the 1997 sexual assault.
TMZ Diddy responded to the complaints and lawsuit by filing two emergency motions on Thursday, September 12, seeking to overturn the landmark ruling. The music mogul claims he never received the lawsuit and only found out through press coverage.
“Combs, who has never been sued, first learned about Cardello-Smith and this action three days ago, when the media reported that this court had entered a default judgment awarding him $100 million,” the lawsuit states.
USA Today notes that Combs’ lawyers are seeking dismissal for improper service and deny any wrongdoing. They argue that “The allegations are completely fabricated on the face of it.”
“This is a frivolous lawsuit against a prominent businessman, based on obvious fabrications, filed by a convicted rapist and serial litigator with an overactive imagination and a thirst for fame,” the lawsuit goes on to explain.
TMZ added that even if the allegations are true — though Diddy’s attorneys dispute it — the statute of limitations expired nearly 17 years ago.
More details on Derrick’s allegations against Diddy
According to TSR, Michigan Judge Anna Marie Anzalone awarded Derrick Lee Cardello-Smith $100 million after Combs reportedly missed an online hearing on Monday (September 9).
Metro Times adds that Diddy is reportedly supposed to start paying Derrick $10 million per month starting October 1.
In his lawsuit, Derrick alleges that Combs drugged and sexually assaulted him after a meeting at a Detroit restaurant. He also claims that they later attended a party where he and a group of women stripped.
TMZ noted that while Cardello-Smith was having sex with a woman, he accused Combs of inappropriately touching his left buttock.
Additionally, the current inmate alleges Diddy gave him a drugged drink at the time, which rendered him unconscious.
Michigan inmate alleges Combs offered him a deal to drop lawsuit
During an August 7 hearing, Derrick requested a restraining order and temporary injunction to prevent Combs from selling real estate or assets to avoid paying the court judgments.
Derrick took the stand at the hearing, alleging that Diddy and his financial adviser had met with him twice within two weeks, providing visitation records as evidence.
He also revealed that Diddy offered him $2.3 million to drop the lawsuit during their first meeting. However, Combs told Derrick he planned to drop the civil lawsuit and risk a default judgment, according to the report.
