Details of Biden’s federal student debt relief plan

As tens of millions of Americans process the news of federal student loan forgiveness, countless questions are being raised about how it will all work.

When will the borrower get relief? Who is eligible? Do you have to apply? The US Department of Education website has been slow to load this week with lots of people looking for these answers.

Here’s what we know so far.

How much of my debt can be forgiven?

Have I received the Pell Grant?

Who is eligible?

The relief will be limited to borrowers earning less than $125,000 per year, or couples or heads of households earning less than $250,000.

If your income falls below this limit in 2020 or 2021, you will qualify.

Which loan is eligible?

The big picture, the vast majority – about 37 million borrowers – will qualify for forgiveness based on their loan type (and then, as long as they’re also under the income limit), because the Their debt falls under the so-called William D. Ford Federal Direct Loan Program. That includes Direct Stafford Loans, and all Directly subsidized and unfunded federal student loans. Under the Direct program, Parent Loan Plus and Grad Loan, are also eligible for assistance.

Then it gets more complicated.

Currently, the Department of Education says that any loan it holds is eligible. That means about 5 million borrowers with a commercially held Federal Family Education Loan (FFEL) could be excluded. (About the same number of borrowers have FFEL loans with the government and they don’t need to worry.)

Borrowers who want to know if their FFEL loans are commercially accessible Studentaid.gov and sign in with their FSA ID. Information will be available at the “My Aid” tab.

Even if your FFEL loan is with a private company, all hope may not be lost.

A spokesperson for the Department of Education said borrowers with those loans can call their servicer and incorporate them into the Direct Loan Program to qualify for forgiveness.

There is currently no deadline by which they need to do this, but perhaps there will be one. Therefore, experts recommend that borrowers in this situation should act quickly.

Another type of loan may also be excluded from forgiveness because it is not in the hands of the government. Some loans from the Federal Perkins Loan Program, Kantrowitz said. Some of these loans are from the Department of Education, but most are held by colleges.

If you pay your monthly loan bill to one of the government’s lending companies, says Kantrowitz, you should be able to get forgiveness, but if your payments go to a company other private loan, maybe you got lucky.

All private student loans are also excluded.

What if I owe less than forgiven?

Student loans after June 30, 2022 will not be included in the relief.

Do I have to do anything to be forgiven?

The Education Department said it will launch an app where borrowers can enter their income data and request a loan forgiveness. Applications will be available before the end of the year, the department said, and Borrowers can register now on its website for updates about the process.

The department also said it had income data for nearly 8 million borrowers because they were signed up for an income-based repayment plan that requested the data. These people can be canceled automatically.

Does loan forgiveness trigger taxes?

Student loan forgiveness will not trigger a federal tax bill.

That’s because the American Rescue Plan 2021 worked student loans are tax free through 2025 – and the law also includes Biden’s pardon, according to a flyer from the White House.

However, you may still be subject to state taxes, says Kantrowitz.

Some states automatically follow federal rules, but others may count forgiven balances as income, which means you can still have state bills. The amount “could be equivalent to a few student loan payments,” Kantrowitz said.

If you’re not sure, contact your local tax professional for an estimate before filing your state tax return.

How do I make sure I really get forgiveness?

Experts recommend taking a picture or screenshot of your current student loan balance. That way, you can guarantee that it will drop to the correct amount once the forgiveness occurs.

What’s going on with the payment pause?

In addition to Biden’s announcement about student loan forgiveness, he said he would payment pause extension for federal student loans through December 31. Payments will resume in January.

This is the seventh extension of the pandemic relief policy started under the Trump administration and it will probably be the last one.
