Chinese smartphone company officially arrested for fraud of Rs 19 billion

Thane, Maharashtra:

The Central Commission for Goods and Services Tax (CGST) of the Mumbai Region on Wednesday arrested a senior official of a Chinese smartphone maker in the Thane district of Maharashtra for alleged credit fraud. Use input tax (ITC) worth Rs 19 crore through fake invoice.

The director of Finance and Accounts department of Oppo Mobiles India Private Limited, Mahendra Kumar Rawat, was arrested in Bhiwandi town and then taken to the local court, which has detained him until 3rd of May. 4, CGST Commissioner Bhiwandi said in a statement.

Based on the physical evidence gathered during the investigation, he was arrested under section 69 of the CGST Act 2017 for violating section 132 of the Similar Act.

The statement said the investigation carried out by the anti-evading wing of the Bhiwandi CGST Commission revealed that Oppo Maharashtra was involved in the supply of fake ITC without receiving any goods.

“Oppo Mobiles India Pvt ltd’s supplier, M/S Gain Hero India Private Limited, was found to be non-existent at the company’s main place of business. In this regard, 16 electronic invoices for the transaction the above has been verified and found to be forged. Furthermore, the statements of the carriers and vehicle owners were recorded, which revealed that there was no supply of goods for Oppo Maharashtra,” it said.

Mahendra Kumar Rawat, authorized signer and CFO and Account Manager of Oppo Mobiles India Private Limited, was the key person who played a key role in the above fraudulent use of ITC amounting to Rs 19275454 against bills up to Rs 107,08,56,072 issued by Gain Hero India Private Limited without consignment, it added.

The CGST Commissioner said the defendant admitted in his statement that the electronic invoices generated were forged.

This case is part of a special effort launched by CGST Region Mumbai against tax fraudsters and tax evaders. Sumit Kumar, Commissioner, Bhiwandi GST Center said that the Bhiwandi CGST Committee has arrested 24 people in the past 18 months.
