The names of the 10 judges proposed by the Supreme Court Council have not yet received consent from the central government. The files, returned on November 25, also include the name of senior lawyer Saurabh Kirpal, son of former Chief Justice BN Kirpal. Sources say some of the names that were repeated by the Collegium have also been returned.

In an interview with NDTV earlier this month, Kirpal said he believes his height is belittled because of his sexual orientation.

“The reason is my gender. I don’t think the government necessarily wants to appoint an openly gay person to the bench,” Mr. Kirpal, 50, told NDTV. His promotion has stalled since at least 2017.

The barrier comes amid a renewed focus on the process of selecting judges for promotion, conducted by the Supreme Court’s Collegium.

A lawsuit filed in the highest court, alleging “willful failure to follow” the time frame set by the court in appointments, is currently being heard by a bench of two judges.

Earlier this evening, the Supreme Court expressed apparent displeasure over the delay in approving Central judicial appointments.

The court said: “Once the Collegium repeats a name, the chapter is over… It (the government) is overtaking the Rubicon by keeping pending names like this.” “Let’s settle this matter and don’t force us to make a judicial decision on this matter,” said the benches of Judges SK Kaul and AS Oka.

“There’s no way you can stay anonymous, that frustrates the whole system… And sometimes when you appoint, you pick some names from the list and don’t remove others. What you do is you effectively break seniority,” the court added.

Union law minister Kiren Rijiju made his stance clear on the issue, pointing out that before 1991, the government chose judges. The current system, he said, is the result of a judicial order, which is “foreign” to the constitution.
