Catering company sued by customers alleging ‘contaminated’ lentils led to gallbladder removal


Vegan meal start-up Daily Harvest has been hit with two lawsuits by customers alleging that they needed to have their gallbladder removed after eating one of the company’s products, report CNN. Last month, the company released a Voluntary withdrawal dish “French Lentils + Leeks” following numerous consumer gastrointestinal and liver claims. The first lawsuit was filed by Carol Ann Ready, an Oklahoma woman who is suing the company in federal court for the Southern District of New York. Pre-purchased and eaten lentil crumbs from Daily Harvest on two separate occasions in May, both of which resulted in emergency room visits. The second of these was a four-day stay, which ended with Ready’s doctor recommending a cholecystectomy.

Lawyers for Ready are asking for a jury trial, alleging that the damages for the case exceed what the usual courts allow. “Plaintiff was seriously injured; has and will continue to suffer from significant pain and other physical discomfort; incur and will continue to incur substantial medical expenses; missed, and may miss in the future, the work and time required to advance her career; and remain at risk of future health complications with damages exceeding $75,000, the threshold of jurisdiction of this court,” complaint, obtained by Food safety news.

Earlier this week, an Oregon-based content creator, who claimed he also ate lentils and subsequently had his gallbladder removed, filed a personal injury lawsuit against Daily Harvest. In one Posting to Twitter on June 21, the plaintiff in the lawsuit, Luke Wesley Pearson, warned his followers not to eat lentil crumbs.

Daily Harvest has yet to determine exactly what could cause an adverse reaction. “All pathogen and toxicology results have been negative so far, but we are continuing with extensive testing so we can dig deep into this. All those affected deserve it. have the answers, and we are committed to doing just that,” the company said in a statement CNN.

Yesterday, FDA officially announced into the outbreak, in an attempt to determine the cause. In a blog post, Daily Harvest said it received about from customers who have had an adverse reaction after eating the product.
