Amid thousands of Indian medical university students studying in Ukraine but having to return home because of the war with Russia, the Center on Thursday told the Supreme Court that they cannot be allowed into the schools. medical college here because of the lack of regulation of the law.

In an affidavit, the Center said that to date, the National Health Commission (NMC) has not authorized the transfer or admission of any foreign medical students at any medical institute/University of India.

“We humbly submit that to date the students concerned, there is no such provision under the Indian Medical Council Act, 1956 or the National Health Commission Act , 2019 as well as Regulations on the admission or transfer of medical students from any foreign medical institutes/colleges to Indian medical colleges,” the government said.

However, it said that to assist and assist returning students who were unable to complete their MBBS courses in Ukraine, the NMC in consultation with the Ministry of Foreign Affairs (MEA) issued a Public Notice dated September 6, 2022, indicates that NMC will accept to complete their remaining courses in other countries (with approval of the university/parent institution in Ukraine).

The government said most of the students / petitioners went abroad for two reasons – firstly because of poor performance on the NEET exam and secondly the affordability of medical education abroad.

“We humbly submit that in the event that these (a) poor performing students are allowed admission to top medical colleges in India by default, there may be some cases of lawsuits from desired applicants who were not able to get a place in these colleges and have entered or lesser known universities or have been stripped of a place in medical colleges”, the government said. know.

The government added that any further easing, including prayer for the transfer of these repatriated students to medical colleges in India, would not only violate the provisions of the Act.
