NEW DELHI: Law Minister Kiren Rijiju in the Lok Sabha on Tuesday said that the government is following the BJP’s request to enact the Uniform Civil Code.
Rijiju was answering a question from the BJP Godda congressman, Nishikant Dubey, who pointed out that several states, including Uttarakhand, are on track to implement a unified civil code.
“Nishikant ji questioned what is the government’s position on the unified civil code… let me tell you the unified civil code is the ideology of our party and it should be considered. is the ideology of the country,” said Rijiju.
Questioned, Dubey said that the Constitutionalists had suggested that there should be a uniform set of civil codes throughout the country and that the need for one was only increased by “social ills like same-sex marriage”. increasing nature or relationship of cohabitation”. .
“Some evil practices have emerged,” he told UCC as a solution, noting that Goa was in effect. “There is a uniform civil code in Goa. Uttarakhand is also capable of doing it,” said Dubey.
During the debate on proposed amendments to the Family Courts Bill, 2022, the Minister told Dubey that the government appreciated his comments on the lack of representation by the lower courts. High Court in Patna and Jharkhand in the High Court and promised to transfer it to university.
“There is no mandatory rule representing each high court in the apex court. However, there has been a convention for the placement of judges from the larger high courts,” the minister pointed out. Rijiju said, “If we have a name and he doesn’t have the ability to be a judge, we can’t just sign (letter of recommendation) blindly. Appraisal must be performed. We have a mechanism to look at a nominee’s background, his actions, his mischief, his achievements. SC university doesn’t have it. If we don’t approve a name, that’s a valid reason for it. We don’t do it to block anyone.”
He was responding to a critical comment by AIMIM MP Imtiaz Jaleel about vacant positions in the Bombay high court, despite the recommendation of SC university. Rijiju said the government has removed several names in recent days and no names are pending for Maharashtra. The minister said the rate of judicial charge had increased to 5 crore and it was a matter of concern, but lamented the “random comment” on the matter.
Regarding the setting up of regional branches of SC, Rijiju said the top court discussed the matter and said that the current system should not be disturbed. However, he said, the issue could be studied in the future.
